Insurance protection
Insurance protection exists, if the planned attendance at the event is not reasonable, because the insured person himself or a co-insured person is affected by one of the following events during the term of insurance protection:
* Death
* Serious injury caused by accident
* Unexpected serious illness
* Pregnancy
* Damage to the property of the insured person as a result of fire, explosion, acts of god or deliberate commission of a crime by a third party, provided that the damage is significant or the presence of the insured person is required for the ascertainment of the damage.
* The insured person has moved due to acceptance of an employment relationship, provided that the tickets were purchased prior to the new employment contract and the distance from the event location and the new residence is more than 100 km.
Co-insured persons are:
* Family members of the insured person
* Accompanying persons, provided a maximum of four persons and two additional minor children purchased and insured the tickets for an event together (insured accompanying persons)
* Guardians
There is no insurance protection if the order is cancelled, due to the event not taking place or being rescheduled and for illnesses, provided they are a psychological reaction to an act of terrorism, riots or civil commotion or to the fear of acts of terrorism, riots or civil commotion.

Insurance Terms and Conditions (VB-ERV/EK 2007) for ticket insurance by Europäische Reiseversicherung AG (hereafter referred to as EUROPÄISCHE)
1. Benefits of ticket insurance from Europäische Reiseversicherung AG
What is insured if the event is not attended?
If the event is not attended for one of the reasons specified in § 3 the price of the tickets (incl. fees) is insured for the insured event.
Under which circumstances will EUROPÄISCHE refund the ticket price (§ 3)?
1. Insurance protection exists if the planned attendance at the event is not reasonable, because the insured person himself or a co-insured person is affected by one of the following events during the term of insurance protection:
* Death
* Serious injury caused by accident
* Unexpected serious illness
* Pregnancy
* Damage to the property of the insured person as a result of fire, explosion, acts of god or deliberate commission of a crime by a third party, provided that the damage is significant or the presence of the insured person is required for the ascertainment of the damage.
* The insured person has moved due to acceptance of an employment relationship, provided that the tickets were purchased prior to the new employment contract and the distance from the event location and the new residence is more than 100 km.
What must the insured person due to file a claim (§ 5) (obligations)?
1. The insured person is required to promptly submit originals of the tickets to EUROPÄISCHE.
2. The insured person is also to submit the following documents to EUROPÄISCHE:
a) Proof of insurance and ticket payment receipt;
b) A medical certificate for serious injury due to accident, unexpected serious illness and pregnancy, a medical certificate from a specialist of Psychiatry for psychological illness;
c) A death certificate in case of death;
d) Suitable proof for damage to property or for moving house.
3. In addition, the insured person must allow EUROPÄISCHE to conduct any reasonable investigation into the cause and amount of its liability, to truthfully provide all relevant information, submit original receipts and, if required, to release attending physicians from their doctor-patient confidentiality, inasmuch as such information is required for assessing liability or the scope of indemnity.
4. If one of these obligations is deliberately breached, EUROPÄISCHE is exempt from its liability to provide benefits. For grossly negligent breach of the obligations EUROPÄISCHE is entitled to reduce benefits to an amount commensurate with the severity of negligence on the part of the insured person. In this respect EUROPÄISCHE remains liable to provide benefits should negligence have no effect on the determination or scope of benefit commitment by EUROPÄISCHE, provided that the insured person did not act maliciously.
2. General ticket insurance terms by EUROPÄISCHE Reiseversicherung AG
Who is insured?
Insured persons are those persons named or described as a group of persons in the proof of insurance, provided that the insurance premium has been paid.
For which event does insurance apply?
Insurance protection applies to each insured event.
§ 1 When does insurance begin and end?
Insurance protection only takes effect if the premium has been paid prior to the beginning of the event and begins
* upon purchase of the tickets, but at the earliest upon purchase of insurance and
* ends upon admission to the respective event.
§ 2 When is the premium to be paid?
1. The premium is due immediately upon purchase of insurance and the issuance of the certificate of insurance.
2. If the premium has not yet been paid prior to an insured event, EUROPÄISCHE is exempt from providing benefits, provided that it is the insurant's fault that payment was not made.
§ 6 When does EUROPÄISCHE pay compensation?
If the reason and amount of indemnity on the part of EUROPÄISCHE has been determined, compensation will be paid within a period of two weeks;
§ 7 What applies when the insured person has claims against others?
1. Claims against others pass over to EUROPÄISCHE in the legal scope and to the amount of payment made.
2. Provided this is required, the insured person is obliged to abandon claims of this scope to EUROPÄISCHE.
§ 8 When does the insured person lose entitlement to claim insurance benefits?
EUROPÄISCHE is exempted from indemnity should the insured person attempt to act fraudulently to EUROPÄISCHE with regard to the circumstances of the insurance claim, which may be significant for the reason or amount of benefits, or make false statements about the reasons for the insurance claim, even if this poses no disadvantage for EUROPÄISCHE. For wilful intent EUROPÄISCHE remains liable to provide benefits should negligence have no effect on the determination or scope of benefit commitment by EUROPÄISCHE.
§ 9 Which court has jurisdiction over the assertion of claims from the insurance policy, which law is applicable?
1. Jurisdiction for lawsuits against EUROPÄISCHE is Munich or the residence of the insurant in Germany.
2. German law applies insofar as it is legally permissible.
§ 10 What are the statutes of limitations on claims?
1. No claims with respect to the insurance policy may be made after a period of three years. The statute of limitations begins at the end of the year in which a claim is made and of which the insured person is cognisant of or must have been cognisant of.
2. If the insured person files a claim with EUROPÄISCHE, the statute of limitations does not expire until the insured person is informed of the decision by EUROPÄISCHE.
